GENERAL AND ORDERING TERMS AND CONDITIONS OF THE CASA RUGS E-SHOP
1. SCOPE AND VALIDITY OF TERMS AND CONDITIONS
1.1. These general terms and conditions and ordering terms and conditions (hereinafter referred to as the Terms and Conditions) of CASA RUGS (hereinafter the Seller) are valid for all parties (hereinafter the Purchaser) who use the e-shop at www.casarugs.eu (hereinafter the e-shop), order goods and services (hereinafter the Goods) in the e-shop by entering into a contract of purchase and sale (hereinafter the Sales Contract) in order to purchase Goods in the e-shop.
1.2. By accepting these Terms and Conditions, the Purchaser confirms that they have read the terms of the Sales Contract, agree to them and will follow them.
2. PRODUCT DESCRIPTION
2.1. We make every effort to ensure that our product descriptions and specifications are correct. However, the product specifications and descriptions on this website are not intended to be binding and are for general descriptive purposes only. Furthermore, while the colours of the products are reproduced accurately, we cannot accept responsibility for any differences in colour caused by the browser software or computer system used to view the products.
3. PRODUCT SIZE AND COLOUR
3.1. All our products are handmade and the width or length of rugs may vary up to +/- 10 cm from the size shown. Similarly, although ARS colours are used to ensure accuracy, colours may vary due to yarn batches when comparing rugs. This is normal for all dyed textiles, as rug yarns are also dyed by hand. By placing an order with us, you confirm that you understand and agree to it. If you need a custom rug in a specific size, please contact us either by phone +372 683 3681 or by e-mail at support@casarugs.eu.
4. STOCK
4.1. We keep a large stock of rugs in our showroom(s) and this website displays most of our current product range. If the product is in stock, it is available for immediate purchase; if it is out of stock, you can order it (see ‘Custom orders and out of stock products’). Most of our rugs are available in both custom and standard sizes and colours.
5. TERMS AND CONDITIONS FOR CUSTOM ORDERS AND OUT-OF-STOCK PRODUCTS
5.1. Custom and out-of-stock products are non-returnable and non-refundable unless the rug has a manufacturing defect. All orders involving custom, custom-fit and out-of-stock products require a 50% deposit prior to order confirmation.
5.2. Our production times range from 12-26 weeks with a 15% surcharge in the case of a double weaving shift. This may vary depending on the season and the schedule of our weaving team. We will inform you at the time of placing your order of the delivery time as accurately as possible or you can request this information by e-mail support@casarugs.eu.
6. PURCHASING GOODS AND PLACING ORDERS IN E-SHOP
6.1. It is possible to purchase those Goods in the e-shop that have an ‘Add to the cart’ link. The price and the availability of the Goods may change at any time and without prior notice. If the Purchaser has placed their order before the price of the Goods changes, the price valid at the time of the order will apply.
6.2. The Seller has the right to withdraw from the Sales Contract entered into via the e-shop and not to deliver the Goods or Service ordered under the following circumstances: The Goods are out of stock, the Goods have an ‘On order’ status in the e-shop (the Goods are out of stock) or the price or qualities of the Goods have been displayed in the e-shop incorrectly due a system error.
7. SHOPPING CART AND PLACING AN ORDER
7.1. You may change the quantity of the Goods in your shopping cart. To order Goods, you must choose a suitable delivery method. More information on the delivery option will be asked later on the ‘Placement of Orders’ page. Please read the purchasing terms and conditions of the e-shop and if you agree to them, please confirm this by ticking a box in front of the terms and conditions.
7.2. In order to confirm an order, the Purchaser must click ‘Add to cart’ which directs the Purchaser to the payment method page where a suitable payment method must be selected. The Purchaser can also change the payment method in the final stage of ordering. The Purchaser’s details must be entered, and they can also register as a CASA RUGS loyal customer if they wish. In the next step, the Purchaser can choose the delivery method and click on the ‘Next’ button. They are then presented with the final choice of payment method required to confirm their order and complete the purchase. The Purchaser can choose the payment method and pay for their purchase. The Purchaser should be very careful when placing an order, as correct details are very critical for quick and uninterrupted delivery of the products ordered.
7.3. The Sales Contract is deemed to have been entered into upon receipt of the amount due according to the order confirmation to the current account of CASA RUGS. The Seller does not process orders that have not been paid for.
8. PAYMENT FOR GOODS
8.1. You can pay for the goods: with a bank transfer or a card payment via Montonio and via PayPal.
8.2. Purchasers can pay with a gift card or a credit card by clicking on the corresponding payment method and by following the instructions displayed.
8.3. We retain ownership of the products ordered until we have received full payment for the products.
8.4. After the payment has been made, the e-shop will send the Purchaser an Order Confirmation. An invoice for the order will be sent to your e-mail address after the goods have been assembled/dispatched.
8.5. All personal data disclosed in the course of visiting CASA RUGS e-shop and making purchases shall be treated as confidential information. The encrypted data communications line with the banks ensures the security of the personal data and bank account information of the Purchaser. Representatives of CASA RUGS do not have access to the corresponding encrypted data.
9. PRICES
9.1. All prices include VAT. We reserve the right to change prices due to changes in currency exchange rates or the global rug market.
10. VAT EXEMPTION FOR EU REGISTERED COMPANIES
10.1. Companies that are liable to VAT in an EU country other than Estonia and that can present a valid EU VAT number will not be charged VAT. Prices on the website are displayed inclusive of VAT; VAT is calculated in the shopping cart after login or registration. 11. DELIVERY AND HANDOVER OF GOODS
11.1. The Goods will be delivered to the delivery address entered by the Purchaser in their order. The Purchaser will be notified of the delivery by using the contact data indicated upon the placement of the order. The ordered Goods will be transported in accordance with the transport terms and conditions in force at the time the order is placed.
11.2. When placing an order, the Purchaser should ensure that the contact details provided are correct to avoid delays and misunderstandings in the delivery of the Goods. CASA RUGS and the delivery company shall not be liable for any delay in the delivery of the Goods and any misunderstandings that may arise if the delay or misunderstanding is due to inaccuracy or incorrectness of the information provided by the Purchaser when placing the order.
11.3. The Goods will be transferred only to the Purchaser and against a delivery bill. Before signing the delivery bill, the Purchaser must carefully check the packaging of the Goods and if the packaging has been damaged, leave a comment on the delivery bill. In the event of a damaged packaging, the Purchaser may refuse to accept the delivery and/or immediately inform CASA RUGS customer service at support@casarugs.eu.
11.4. The Goods will be transferred to a third person, if they have a letter of authorisation (including in the event that the Purchaser has indicated a third person in their order as the recipient). The Seller may authorise third persons (including a courier service) to deliver the Goods.
11.5. If the Purchaser fails to collect the Goods within 14 (fourteen) days of the agreed date of the collection of the Goods, it will be deemed that the Purchaser has violated the Sales Contract and they do not wish to receive the Goods. The Seller has the right to unilaterally withdraw from the Sales Contract and to request compensation for the damage (e.g. costs of Goods storage) and to settle the damage incurred by the amount of money prepaid by the Purchaser.
12. RIGHT OF WITHDRAWAL
12.1. This withdrawal procedure does not apply in the case of withdrawal from a consumer credit contract. The procedure for withdrawal from a consumer credit contract is laid down in the said contract.
12.2. The Purchaser has the right to withdraw from the Sales Contract entered into in the e-shop within 14 days without providing a reason.
12.3. In order to establish the nature, characteristics and functioning of the goods, the Purchaser should only handle and use the goods in the same manner as the consumer would customarily be allowed to do in a shop. (subsection 562 (4) of the Law of Obligations Act). In the event of deterioration of the Goods to be returned, the Purchaser shall be liable for the loss of value of the Goods due to their use, and the Seller shall be entitled to claim compensation from the Purchaser to the extent of the loss of value.
12.4. The withdrawal period expires 14 days after the entry into the Sales Contract or as of the day the Purchaser or their representative has physically received the Goods.
12.5. In order to exercise the right of withdrawal, the Purchaser must notify the Seller of their decision to withdraw from the Sales Contract in writing and deliver it to the Seller’s shop or forward it via e-mail. You can also notify the Seller of your withdrawal via the product return form at www.casarugs.eu/return_form.

13. ABSENCE OF RIGHT OF WITHDRAWAL
13.1. The Purchaser has no right to withdraw from the Sales Contract if:
13.1.1. The Goods in question are custom made items in a sealed package. A custom order is a product specially made to customer specifications (for example, in a colour that is not in the range or a product made to specific dimensions).
13.1.2. The subject of the Sales Contract is a gift card and its unique code has already been used.
13.1.3. The Goods must be returned in their original packaging with their original labels and in their original condition (including all of the items in the product packaging and any gifts related to the Sales Contract).
13.1.4. If the Purchaser uses the Goods more than is necessary to ascertain the nature and functioning of the Goods or does not return the Goods in their original packaging and in their original condition, the Purchaser will be liable for any diminution in the value of the Goods.
14. WITHDRAWAL FROM SALES CONTRACT
14.1. Upon withdrawal from a Sales Contract, CASA RUGS will immediately reimburse all received contractual payments, including delivery costs (apart from additional costs arising from the Purchaser’s preferred delivery method which differ from the cheapest and most common method offered by CASA RUGS, but no later than 14 days after the day on which the Seller learned of the Purchaser’s decision to withdraw from the Sales Contract.
14.2. CASA RUGS will refund the aforementioned sums using the same method that the Purchaser used to make the payment, unless the Purchaser proposes an alternative method. There is no service charge or other cost to the Purchaser in the case of refunds of such payments.
14.3. The Purchaser must return the Goods to CASA RUGS without undue delay, but no later than within 14 days from the day they notified CASA RUGS of their withdrawal from the Sales Contract. Goods may also be returned to CASA RUGS warehouse address subject to prior agreement. The time limit will be deemed to have been observed if the Purchaser returns the Goods which are the subject of the Sales Contract before the expiry of the 14-day time limit.
14.4. The Seller has the right to refuse to make the refund until they have received the Goods being returned.
14.5. If the Purchaser wishes to avoid paying for the diminution in value of the Goods, the Goods must be used and tried as they would be in a normal shop and the Goods must be returned in their original packaging and in their original condition (including all items in the product packaging and any gifts related to the Sales Contract). If the Purchaser uses the Goods more than is necessary to ascertain the nature and functioning of the Goods or does not return the Goods in their original packaging and in their original condition, the Purchaser will be liable for any diminution in the value of the Goods.
14.6. The Purchaser must cover any direct costs arising from packaging the Goods to be returned and returning the Goods.
14.7. In the case of any deterioration of the Goods subject to return, the Purchaser is only liable for the diminished value of the Goods if the Purchaser used the Goods in a manner other than what is necessary to establish the nature, characteristics and functioning of the Goods. In order to establish the nature, characteristics and functioning of the Goods, the Purchaser should only handle and use the Goods in the same manner as they would customarily be allowed to do in a shop.
14.8. CASA RUGS has the right to submit claims arising from the decrease in the value of the Goods against the Purchaser within one month of receiving the returned Goods.
14.9. If the Purchaser has used or tried the Goods to be returned in a way other than what would normally be allowed in a shop, or has used the Goods more than is necessary to ascertain their nature, characteristics and performance, the Purchaser will be liable for any diminution in the value of the Goods and the Seller is entitled to deduct such amount from the purchase price to be returned. If the Purchaser does not agree with the decrease in value indicated by the Seller, they have the right to consult an independent expert to establish the decrease in value. The expenses of the independent expert will be paid by the party whose opinion is not substantiated. If identifying this party proves impossible, the costs related to the expert assessment will be divided in half between the Purchaser and the Seller.
15. CANCELLATION OF SALES CONTRACT
15.1. The Purchaser has the right to cancel their order without any extra costs after having paid for it, but before the Goods are dispatched from the warehouse. In order to cancel the Sales Contract/Order, the Purchaser must send a corresponding notice and the number of the Sales Contract by e-mail to support@casarugs.eu. In the event of the cancellation of the Sales Contract, the Purchaser is sent a confirmation.
16. PRINCIPLES OF DATA PROTECTION AND PROCESSING
16.1. The Seller ensures that the Purchaser’s data, including their personal data, are protected and used according to the Privacy Policy. The Purchaser confirms that they have read and agree to the terms of the Privacy Policy and the Cookie Policy. Subject to applicable legislation and the provisions of the Privacy Policy, the Purchaser will have the right to process data (including personal data) without the consent of the Purchaser to the extent necessary for the operation of the e-shop, the performance of the Sales Contract or for ensuring the performance of the Sales Contract. Arising from the foregoing, the Seller has among others the right, without separate consent, to: send the Purchaser notices related to the use of the services in the e-shop, including such notices that are in the interests of the security of the e-shop users; to store the data on the orders of the Purchasers who have logged in for the purpose of their better service and the verification of transactions, including, within reasonable time limits, the data on the orders that the Purchaser did not place during a session.
16.2. If the Purchaser has granted their consent for the use of their data for marketing purposes either by the entry into a Customer Contract or by any other declaration of intention (e.g. in self-service) that confirms their consent, the Seller will use these data subject to the terms and purposes set forth in the Privacy Policy, including for sending personal direct marketing, campaign and discount offers for goods and services to the Purchaser electronically (e.g. by e-mail or text messages).
16.3. The Buyer has the right to withdraw the consent given for use of the data for marketing purposes at any time by sending the respective e-mail to the Seller or to opt out of receiving further direct marketing offers by following the instructions in the direct marketing offer sent to their e-mail address.
17. LIABILITY AND DISPUTES
17.1. The Purchaser is entitled to file complaints to the Seller with regard to non-conforming (defective) goods over a period of two (2) years from the date of their delivery. A complaint has to be filed immediately but no later than within two (2) months from the detection of the defect. After the detection of the defect, the Purchaser has to take all reasonable measures for the preservation and protection of the Goods, including not to use the defective Goods if this would further deteriorate the condition of the Goods.
17.2. The Seller has the right not to accept claims in terms of Goods that are defective or faulty as a result of improper use or maintenance, because the Goods are a handmade product:
17.2.1. During use, protruding yarn fibres may appear, which can be removed with sharp scissors. This is a natural characteristic of handmade products.
17.2.2. In areas with heavy foot traffic, the Goods may experience natural physical wear (e.g. yarn fibres coming loose from the yarn).
17.2.3. When using the Goods, the yarn may sink lower, i.e. lose its original pattern height. Additionally, placing heavy objects on top of the Goods may leave a mark.
17.2.4. The Goods visually show an uneven distribution of colours in the yarns (e.g. wool, silk), which is inherent to the materials used.
17.2.5. The working yarn of the Goods has become visible, which is a natural characteristic of handmade products.
17.2.6. The yarn used in the finishing of the edges of handwoven Goods may come loose if the Goods are used incorrectly.
17.2.7. Exposure of the materials of the Goods to chemical agents may alter the original properties/appearance of the Goods.
17.2.8. Fading, wear, loss of colour of the Goods. Often this is due to exposure to sunlight and improper care.
17.3. If the Goods do not conform to the terms of the contract, the Purchaser may exercise all legal remedies, including to request the repair or replacement of the Goods or to withdraw from the Sales Contract and to return the non-conforming Goods.
17.4. CASA RUGS is not liable for: the deterioration of/damage to the goods by the fault of the Purchaser, for the defects caused by the irregular use of the Goods and for the normal wear and tear resulting from the regular use of the Goods.
17.5. If the Seller or the manufacturer has granted warranty against defects to the Goods, the warranty terms and conditions in written form will be delivered to the Purchaser along with the Goods and/or will be made electronically available in the e-shop.
17.6. The Purchaser must keep the purchase documents (invoice, contract) that verify the purchase of the Goods from the Seller’s e-shop for the resolution of possible later problems. The Seller/customer service assistant has the right to not resolve the problem, if a purchase document is missing.
17.7. Claims relating to Goods purchased from the e-shop can be submitted to: CASA RUGS e-shop, Kentmanni 10-62, Tallinn 10116, e-mail: support@casarugs.eu.
17.8. When submitting a claim, you must also specify the defective Goods and add photos of the Goods.
17.9. Defects of the Goods shall be resolved according to the Terms and Conditions of Filing Complaints of CASA RUGS, which form an integral part of the Sales Contract and these Purchase Terms and Conditions, and which the Purchaser has accepted before entry into the Sales Contract.
17.10. The Seller shall ensure that the Goods sold in the e-shop conform to the standards effective in the European Union. The circumstances highlighted in these standards will not be deemed as defects of the Goods.

17.12. The Purchaser has the right to contact the competent supervisory authority, which is the Consumer Protection and Technical Regulatory Authority at Pronksi 12, 10117 Tallinn, e-mail: info@ttja.ee. The Purchaser may refer the dispute to the Consumer Disputes Committee for resolution. The Consumer Disputes Committee is authorised to resolve disputes arising from the contracts entered into between the Purchaser and the Seller that the parties have failed to settle by way of negotiations. 17.13. CASA RUGS will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
18. MISCELLANEOUS
18.1. Product images are for illustrative purposes.
18.2. Prices and availability of Goods are subject to change without notice. In connection with the former, CASA RUGS reserves the right to cancel the sales transaction and to refund the money to the Purchaser within reasonable time to their bank account.
18.3. CASA RUGS e-shop reserves the right to cancel the sales transaction, if one of the following Goods-related problems has occurred: human error in entering the price or technical error in the system (e.g. if a rug worth EUR 1000 is sold for EUR 10, this is an obvious error). Therefore we assume that the Customer would understand that this is an error and the product will not be sold at that price).
18.4. Product information is regularly checked and updated. The data may have been updated after the Purchaser’s last visit. Due to the incompleteness of manufacturers’ data sheets, CASA RUGS e-shop product information may contain inaccuracies. In this case, CASA RUGS e-shop does not take any responsibility for the correctness of the product information. However, we recommend that the Purchaser check the accuracy of product information before purchasing by calling CASA RUGS Customer Service Department at (+372) 683 3681.

No part of the design of the CASA RUGS brand may be reproduced, distributed or transmitted in any form or by any means, including the creation of prototypes, drawings, etc., without the prior written permission of the brand, except for non-commercial purposes permitted by copyright law. 20. VALIDITY OF TERMS AND CONDITIONS
20.1. These seller’s e-shop terms and conditions are valid from 1 July 2025.
